Abstract
The legislation of the A legislação do Sistema Único de Saúde (Single Health System - SUS) defi nes the participation of the private sector in a complementary and supplementary manner. It outlines which health actions and services should be regulated, controlled and overseen by the government. Data from the Agência Nacional de Saúde Suplementar (National Agency of Supplementary Health - ANS) show that 35,499,446 people were benefi ted by private health care plans in 2002, 20% of the Brazilian population. They are concentrated in the Southeast (70%), with the state of São Paulo having the greatest coverage, with 44.12%. In the São Paulo Metropolitan Region (RMSP) in 1998, 45% of the population had private plans. The public health sector has a double challenge: increase access to its services and meet the social security objectives; and regulate, control and fi nance in fact the private sector. Taking as its assumption that the relationship between the SUS and the supplementary sector of health services creates, maintains and reproduces inequalities, this study developed by the Nucleus of Services and Systems of the Health Institute analyzed the relationship between the public and private sectors of the RMSP regarding government strategies to strengthen the
regulatory capacity of the SUS and increase equity. The results allow the recognition of how the competencies are made operational foreseen under SUS legislation, relative to regulation, control and overseeing of the private sector, with the objective of promoting the strengthening of these attributes, with equity as the guide.
